$280M Dish TCPA Penalty May Make Settling More Attractive
Partners Ashley Taylor and David Anthony were quoted in Law 360 about the fall-out from Monday’s record setting $280 million penalty handed down to Dish Network for violating the FTC's Telemarketing Sales Rule, the TCPA and various state statutes. From Ashley’s perspective, "The Illinois decision highlights the 'new normal' in regulatory enforcement matters, specifically that state attorneys general and federal regulators — and not just class action plaintiffs — will aggressively pursue companies based upon the conduct of their vendors." David agrees, “Many companies have focused their efforts solely on their own actions and given less attention to those vendors or third parties working for them. This ruling makes clear that a company’s liability may well encompass — to the tune of hundreds of millions of dollars — the full spectrum of all employees, vendors and third parties that provide any services on its behalf."
