5 Tips for Meeting the New Federal Discovery Rules

In it, Alison addresses how the Federal Rules of Civil Procedure, which became effective on Dec. 1, affect the way one handles discovery.
“The revised rules emphasize case management and proactive discovery by adding several mechanisms to front-load discovery decisions and emphasis proportionality in the discovery process,” she writes. “They also provide guidance for when sanctions for failure to preserve electronically stored information (ESI) are appropriate.” Alison provides five practice pointers that should keep one from avoiding sanctions, reduce risks and get to the merits of their case “without a discovery sideshow.”
