5th Circ. Puts EPA Power Plant Effluent Rule Fights On Hold

In December 2015, power industry groups challenged an effluent limitations rule, claiming the U.S. Environmental Protection Agency (“EPA”) violated the Administrative Procedures Act by failing to disclose how it reached conclusions that resulted in the rule. On Aug. 14, the EPA asked the Fifth Circuit to delay industry challenges to the rule as it works to revise portions of it. On Tuesday, the court granted the request. Partner Sean M.
