Atlanta attorneys win verdict: contract trumps alleged sales claims in condo view lawsuit
Atlanta partners Thomas E. Reilly, William N. Withrow Jr. and associate Brian P. Watt’s win for developer Novare Group in the Georgia Supreme Court garnered news in a November 22 Daily Report article.
According to the article, the Court on November 21 reaffirmed “a bit of conventional wisdom that should be uppermost in the mind of anyone making a purchase, be it for a new cell phone or a condominium with really gorgeous views: Forget what the salesman says and read the contract.”
Reilly, who represented Novare along with Withrow and Watt and who argued the case before the high court, said his client was pleased with the unanimous decision.
“As the Court held, real estate purchasers are not entitled to back out of a written agreement based on claimed statements from on-site sales personnel that contradict the written terms and disclosures of the contract,” said Reilly. “We are gratified to be vindicated and to have this litigation finally come to a close after three years.”
