Belmont Park lease ruled legal; upgrades to proceed
San Diego Managing Partner Mike Whitton is quoted in a San Diego Daily Transcript story about a recent ruling that allows upgrades to Belmont Park in Mission Beach to continue and preserves the lease of the property through 2070. Whitton is quoted several times throughout the story, saying, "This is a historic site and [Pacifica] has invested a lot of dollars to bring it back to its glory. We're preserving a city asset and amenity that the public enjoys, so we're delighted about the outcome." According to the story, “Because the original lessee had received approval for upgrades on the park, invested substantial expenditures and performed construction on the project before Prop G's adoption, the property was then deemed to have obtained the vested right under the initiative and was therefore exempted from the development restrictions, Whitton argued.” Whitton led the Troutman Sanders team on the defense with Partner Peter Villar arguing.
