Boat Co. Derides Foe's Last-Ditch TC Heartland Transfer Bid
The patent suit between the Cobalt Boats and Sea Ray Boats is heating up. The suit claims Sea Ray infringes a patent on a "retractable swim step,” a partially submerged platform that allows boat passengers to easily get in and out of the water. On Wednesday, May 31, Sea Ray requested a transfer citing last week’s U.S. Supreme Court’s TC Heartland decision which limits where patent suits can be filed. The next day, Cobalt responded that the decision in TC Heartland didn’t change the fact that Sea Ray had slept on its chances to fight the venue earlier in the suit.
