Capital One Says Alice Dooms Intellectual Ventures IP Suit
Richmond partners Robert Angle, Dabney Carr and Megan Rahman; Tysons Corner partner Mary Zinsner;Atlanta partner Paul McGowan; and Tysons Corner associate Mohsin Reza were mentioned in a January 22 Law360 article for their representation of Capital One Financial Corp.
In their role as legal advisors, the sextet, along with lawyers from other firms, is urging a Maryland federal judge to toss mobile banking and security technologies patent infringement claims from Intellectual Ventures LLC against Capital One. They assert these claims violate the test established by the Supreme Court in last year’s Alice decision, where the high court held that abstract ideas implemented using a general purpose computer are not patent-eligible.
“This principle cannot be circumvented merely by expressing the idea as a series of routine steps, implementing the idea using general-purpose or well-known components, or embellishing the idea with other inconsequential features or field of use limitations,” they said in a motion before the court.
