Citing TC Heartland, Judge Sends Racing IP Suits To Calif.

Last year, the plaintiff accused NeckGen Inc., Impact Racing Inc. and Mastercraft Safety, Inc. of patent infringement for a device used to protect the head and neck during motorsport crashes. On August 22, a federal judge agreed with defendants and ruled that venue was improper in the Western District of North Carolina in view of the recent TC Heartland Supreme Court decision, finding that it constituted an intervening change in the law.
