Culling Consent From 11th Circ. TCPA Case
Richmond partners David Anthony and Alan Wingfield, and San Diego associate Naomi Spector had their article, “ Culling Consent From 11 th Circ. TCPA Case,” published October 16 on Law360.
According to the trio: the Eleventh Circuit issued a defense-favorable opinion under the TCPA, finding that prior express consent can be provided by an intermediary and for broad collection purposes. In so doing, the Eleventh Circuit expressly held that only the circuit courts have the authority to determine the validity of FCC orders.
