FTC Enforcement Trends In 2013 And 2014 For FDCPA
Richmond partners David Anthony, Alan Wingfield and associate Scott Kelly had their article – “ FTC Enforcement Trends In 2013 And 2014 For FDCPA” – published May 1 on Law360.
“In 2013, the Federal Trade Commission, perhaps spurred by headline-grabbing narratives from the Consumer Financial Protection Bureau, embarked on one of its most aggressive Fair Debt Collection Practices Act enforcement campaigns in recent history. … [and] has shown itself to be a very active cop on the debt collector beat, with an expansive view of the requirements of federal law,” the three state in the opening of their article.
The article then examines the FTC’s enforcement actions of 2013, its consent orders and amicus briefs for that year, and trends that are likely to be “borne out” by the commission in 2014.
