Golden State Warriors Can't Block Fan's App-Spying Suit
Troutman Sanders is mentioned in a Law360 story about developments in a proposed class action against an NBA team and related parties that alleges privacy violations. According to the story, “[Plaintiff] brought her putative class action on behalf of other Golden State Warriors basketball fans who downloaded the professional basketball team’s app onto their smartphones. The suit, filed last August, alleges that the app, developed by YinzCam, uses the phone’s microphone to track the user’s location by picking up on sonic beacons built by Signal360, but fails to warn users that it is doing so or that it is picking up nearby conversations in the process.” On November 20, 2017, a California federal judge dismissed YinzCam from the suit saying the plaintiff failed to demonstrate the company was more than just a conduit for the communications and ruling that the claims pertaining to YinzCam could not be amended, saying such an attempt would be futile.
