LANDS' END: Gorss Motels Files TCPA Class Action Over Junk Faxes
On March 3, the Class Action Reporter newsletter republished a blog post by David Anthony and Ross Andre detailing a putative TCPA class action filed in January against Lands’ End. The plaintiff, Gorss Motels, alleges it received an unsolicited fax advertisement without the required opt-out language from Lands’ End, a violation of the Junk Fax Protection Act of 2005. David and Ross explain that although the fax was initially addressed to Wyndham Worldwide Corp., Gorss Motels is proceeding with the case based on the theory that TCPA liability attaches to the entity whose goods and services are advertised—in this case, Lands’ End—regardless of the intended recipient.
