Water shortages are most often thought of in the context of drought, climate change, and over-allocation. However, the availability of water is increasingly affected by implementation of Federal law requirements.
This panel will explain how federal laws and programs are affecting available water, with particular emphasis on Clean Water Act regulatory programs, including TMDL implementation and development of water quality standards for flow, as well as laws aimed at protecting threatened species and habitat, such as the Endangered Species Act and the Migratory Bird Treaty Act. Additionally, market-based water quality trading programs provide new incentives in how regulated entities achieve water quality goals, and these programs affect water availability as well.
