MoH & MOFCOM Tentative Measures of Administration over Establishment of Wholly-owned Hospitals in Mainland China by Hong Kong and Macao Service Providers (MoH MOFCOM Circular 109) 关于印发《香港和澳门服务提供者在内地设立独资医院管理暂行办法》的通知 卫医政发[2010] 109号
On December 22, 2010, the Ministry of Health ("MOH") and Ministry of Commerce ("MOFCOM") issued some Tentative Measures regarding Establishment of a Wholly-owned Hospital in Mainland China by Hong Kong and Macau service providers ("Tentative Measures"). These Tentative Measures took effective on January 1, 2011.
Qualifications for the investor:
1. The Hong Kong or Macau service providers that apply for the incorporation of a wholly-owned hospital shall be a legal entity that is able to take the full civil responsibility, shall either directly or indirectly have the experience in the medical investment and management and shall meet one of the following requirements:
a). The investor can provide advanced hospital management experience, management model and service model; or
b). The investor is able to provide internationally advanced medical technology.
2. Qualifications for a wholly-owned hospital invested by Hong Kong or Macau investor:
a). a wholly-owned hospital shall be established in the form of an independent legal entity;
b). the total investment of a third-class hospital shall be not lower than RMB50 million, the total investment of a second-class hospital shall be not lower than RMB20 million; and
c). it shall comply with the qualification for a hospital in the second class.
