Navigating The Pitfalls Of Civil Investigative Demands
Partners Chris Browning, Siran Faulders and Steve Rosenthal offer advice for navigating the pitfalls of civil investigative demands (“CIDs”) in an article published in Law360. They write, “While receipt of a CID is never welcomed by a company, the costs of a CID can be significantly reduced by following an organized, well-documented collection of the relevant data and a response effort consistent with these 10 points. If there can be a silver lining associated with receipt of a CID, it is that the government’s inquiry often gives companies an opportunity to focus on compliance issues which, if left unaddressed, could produce more costly litigation.”
