Nicolet Restaurant: Court Relies on Spokeo to Dismiss FACTA Case
On Feb. 14 Class Action Reporter republished a December blog post by Mike Lacy and Brooke Conkle on the dismissal of a proposed class action alleging that Nicolet Restaurant of de Pere did not properly truncate credit card expiration dates on receipts. The restaurant and its ownership – the Oneida Tribe of Indians of Wisconsin – were both named as defendants in the complaint. However, the Court found that the presence of the expiration date on the receipt did not harm the plaintiff or risk compromising his identity.
