Potential SAFETY Act Issues For Insurers To Consider

The article first discusses the scope of the Support Antiterrorism by Fostering Effective Technologies (“SAFETY”) Act, especially in light of policyholders’ increased interest in the Act’s protections given recent events. Brandon then discusses prospective challenges and vulnerabilities carriers should weigh, especially based on the Act’s uncertain application. He concludes that, even though the Act’s protections from liability are seemingly broad, because they have yet to be tested, carriers should not assume policies issued to policyholders who are approved under the Act will never be reached.
