Pruitt EPA Gives Cos. New Way To Fight Superfund Costs
Andrew Perel was quoted in a May 15 Law360 article about revisions made by EPA Administrator Scott Pruitt to the Comprehensive Environmental Response, Compensation and Liability Act, giving him the ability to sign off on Superfund remedies costing $50 million or more. Of this change, Andrew told Law360 that, “The great majority of Superfund remedy expertise has previously been at the regional level, and that Pruitt's directive will mean he'll have to find experts of his own to complete the remedy reviews.” He added, “Without thoughtful attention to staffing expertise, this could actually cause a significant logjam, a result which appears to be contrary to the purpose articulated. I think it's going to require some very thoughtful attention to staffing and expertise to prevent this kind of logjam."
