Settlement Proves Costly in Case of Pre-Recorded Phone Calls
Troutman Sanders lawyer Ross D. Andre was quoted in a Dec. 1 Northern California Record article discussing Stemple v. QC Holdings., a $1.5 million Telephone Consumer Protection Act class action settlement. Ross commented on the structure of the TCPA and the risks that its strict-liability regime poses for defendants and the fact that the TCPA does not account for the frequency with which mobile phone numbers change hands. He also addressed how this settlement might serve as a guidepost in determining the value of future similar settlements.
