TCPA: Plaintiff Seeks Dismissal of Class Claims
In Eileen J. Downing. v. Papa John’s USA., Inc., No. 2:12-cv-422, Plaintiff filed a national class action against Papa John’s for alleged violations of the Telephone Consumer Protection Act (TCPA) arising from text promotions sent by Papa John’s. Plaintiff is represented by attorneys from Virginia and Louisiana, and Troutman Sanders represents Papa John’s.
After investigation and many substantive exchanges regarding the evidence of consent and Papa John’s opt-in procedures, Plaintiff agreed to dismiss all class claims against Papa John’s. The Court entered an order dismissing the TCPA class claims. The case is now limited to Plaintiff’s individual claims.
