TCPA Suits Get Another Boost as 3rd Circ. Defines Autodialer
Richmond partners David Anthony and Alan Wingfield were quoted in an October 26 Law360 article about the Third Circuit endorsing the Federal Communications Commission’s broad definition of “autodialer” in reviving a Telephone Consumer Protection Act suit against Yahoo. In doing so, the FCC has expanded the universe of businesses that can be dragged into the growing class action fold, the paper declares.
“The impact of this opinion, while unpublished, is that more courts likely will view the FCC order as legitimate and may be forced to give an increasingly broad view of the TCPA to common sense cases,” David and Alan said. “In short, good facts in good cases could still result in bad case law.”
