Having declared the climate science as settled, the Administration is moving forward with federal regulation of greenhouse gas emissions. The Environmental Protection Agency (EPA) has re-proposed new source standards regulating CO2 emissions from new power plants, and this summer the Agency plans to propose guidelines to regulate CO2 emissions from existing power plants. Unlike new source standards, which are developed and implemented by EPA, existing source guidelines are implemented by the states. These regulations will have impacts and implications for all industry. At the same time, the U.S. Supreme Court is actively evaluating EPA’s first round of greenhouse gas regulations, specifically, whether regulation of greenhouse gases from motor vehicles requires stationary source regulation. This presentation will address the current status of greenhouse gas regulation, including Supreme Court review, and the impacts and implications for industry and the states.
