Orange County partner Ron Raether and San Francisco partner Mark Mao had their article –– “To address cyber vulnerability, address the human factor” – published in the San Francisco Daily Journal on October 29.
“Although much of the cyber-breach litigation has focused on Article III standing issues in the past 3 years, little has been said about the debate on the standard of care. In addition, organizations with privacy compliance programs often confuse paying for security technology with having good security,” the duo stated in a summary. “This article addresses human error as the most common vulnerability, and encourages more careful attention to training, clear written policies, and auditing, because for well prepared organizations, human error may not necessarily mean negligence.”
