Utility Seeks to Dismiss CWA Ash Suit as Advocates Hint at Future Cases
Troutman Sanders’ legal arguments in Sierra Club v. Virginia Electric and Power Company d/b/a Dominion Virginia Power were highlighted in a May 27 InsideEPA article about the case, which is the latest in a wave of citizen enforcement suits brought by Sierra Club and Southern Environmental Law Center against electric utilities for allegedly illegal storage of coal ash. The case involves Dominion’s power station in Chesapeake, Virginia, and involves novel claims of liability under the Clean Water Act.
