Washington partner pens two articles
Washington partner Merril Hirsh’s article – “ Getting to Yes … or No: Dispute Resolution that Really Resolves Disputes” –was published in the current edition of Alternatives magazine, the newsletter of the International Institute for Conflict Prevention & Resolution. In a humorous yet informative piece, Merril “rail[s] against, or better put, [suggests]” ways to manage a case through arbitration – from getting control over case costs to changing the incentive for sides to reach a compromise and settlement on a matter. “Arbitrators that create the incentives to solve problem efficiently are more likely to solve them efficiently,” Merril stated in his closing. “Sometimes the ability to get to ‘no’ is the best way to get to ‘yes.’”
He also had his article – “ Where Else Do We Bring Alternative Dispute Resolution Skills to Dispute Resolution?” – (co-authored with ADR practitioners Jim Rhodes and Karl Bayer) published on July 2 in Disputing. The article is the fifteenth in a series that discusses the role of Special Masters in complex litigation and how litigants can best use them to improve their litigation experience. “In Part Fourteen, we discussed a program in California state courts that makes regular use of special masters in construction cases,” the trio state. “So who else is making regular use of alternate dispute resolution talent?” To find out, read more here.
