Washington partners pen two part article on D&O insurance
Washington partner David Gische and Washington associate Meredith Werner had their article “D&O Insurance, An Overview” published in a two part series on Law360. Part 1 was published January 12 and Part 2 was published January 19.
The articles serve as excellent training supplements for companies’ current insurance materials and address some of the primary legal and coverage concerns under D&O policies that must be considered by underwriters, claims handlers, corporations and their executives, and the attorneys who represent them.
“Although D&O insurance has now been a fixture in corporate America for the past 30 years, the terms of coverage are constantly evolving and new risks develop that need to be addressed,” Gische and Werner conclude in their article. “Congressional legislation such as the Dodd-Frank Wall Street Reform and Consumer Protection Act will create new exposures for directors and officers, which may well lead to new policy terms and conditions. D&O insurance is now a mature market, but there are constant challenges that will lead to changes in the years ahead.”
