Although civil litigation often takes the forefront in the board room when considering contested issues, dispute resolution in highly regulated areas such as environmental permitting and enforcement can be equally high profile and create lasting consequences for the future course of business development and management. We have broad experience in all aspects of administrative hearing before federal and state agencies, as well as judicial review of those decisions on appeal.

  • Represented a chemical company in a challenge to the company's receipt of an air-quality permit. Obtained an administrative law judge decision after an eight-day hearing, which upheld issuance of the permit without modification. The decision was subsequently affirmed by the court of appeals.
  • Represented a state agency as special assistant attorney general in bankruptcy proceedings involving the allocation of cleanup costs for property leased from the agency.
  • Represented an international chemical company in an administrative challenge to Title V permit conditions.
  • Defended an industrial facility in a 17-day hearing against a challenge brought by an environmental group to a surface-water withdrawal permit.
  • Represented an individual in an administrative hearing opposing the issuance of a permit for landfill expansion.
  • Represented an individual in a challenge to a permit issued pursuant to the Shore Protection Act.
