Alan Bakowski represents businesses in civil litigation in state and federal courts throughout the country, specializing in complex commercial disputes. He has represented financial institutions, multinational corporations, and small-to-medium sized businesses in a variety of business disputes, ranging from breaches of contract to cases involving fraud, breaches of fiduciary duty, unfair competition, and violations of antitrust laws.

Alan also has expertise in the area of trust law, where he has represented the trustees in a complex family trust dispute involving hundreds of millions of dollars in trust assets. Alan has experience working with numerous economic experts in the litigation context to discuss business valuations and theories of economic damages. Alan also has significant experience drafting appellate briefs in state and federal courts, including the U.S. Supreme Court.

Representative Matters

  • Counsel to Cartoon Network, Inc. and Cable New Network, Inc. in separate putative class actions stemming from claims that content viewed on Cartoon Network and CNN mobile software applications violated the Video Privacy Protection Act.
  • Counsel to Reed Construction Data, a Reed Elsevier Company, in a corporate espionage lawsuit against The McGraw-Hill Companies, Inc., involving claims of monopolization under Section 2 of the Sherman Act and unfair competition under the Lanham Act and state law.
  • Counsel to merchant service provider in breach of contract dispute with electronic payments processor in Texas state court, which resulted in successful settlement at mediation.
  • Counsel to numerous financial institutions in loan default and foreclosure proceedings, including management of court-appointed receivers.
