Amy Williams is a partner in the Charlotte office and focuses her practice on financial services litigation and bankruptcy. She has over twenty-five years experience representing lenders and other creditors in complex commercial litigation, consumer class actions and related matters. Ms. Williams represents financial institutions in connection with False Claims Act and FIRREA actions, internal investigations and government investigations. She has extensive experience representing secured and unsecured creditors in commercial and consumer bankruptcy proceedings.

Representative Matters

  • Defense of financial institution in False Claims Act action challenging mortgage origination and government guaranty claim practices.
  • Defense of financial institution in False Claims Act and FIRREA action involving government insured loans.
  • Representation of mortgage servicer in connection with consumer bankruptcy matters involving the Executive Office of the United States Trustee.
  • Representation of mortgage servicers in connection with internal and federal investigations.
  • National coordinating class counsel for mortgage loan servicer in connection with actions alleging improper document signing and foreclosure practices. All class matters dismissed at early stages.
  • Obtained summary judgment for state charted bank and affiliate in multiple cases involving lender liability claims asserted by borrowers against mortgage lenders based on alleged violations of state security laws, Interstate Land Sales Act, fraud and negligent underwriting.
  • Defense of class actions in state and federal court arising out of allegations of violations of state and federal consumer finance regulations.
  • Defense of lender liability claims asserting control theories, bad faith and related theories.
