Appeals Court Upholds Trademark Ruling for Troutman Sanders’ Client Via Varejo S/A

ATLANTA – On Friday, August 3, 2018, the Eleventh Circuit Court of Appeals affirmed the Southern District of Florida’s (Miami Division) judgment following a four-day bench trial last summer that awarded Via Varejo S/A the casasbahia.com domain name. After oral argument held in Miami on June 26, 2018, the Eleventh Circuit agreed with the district court’s finding that Via Varejo was using “Casas Bahia” as a trademark in United States commerce.

Via Varejo is a Brazilian retail company with annual revenue of $8 billion. Its Casas Bahia subsidiary is one of the world’s largest electronics and home appliances retailers with nearly 750 retail locations and 57,000 employees located throughout Brazil. At trial, the appellant Direct Niche was found to be a cybersquatter in violation of Via Varejo’s rights under the Anticybersquatting Consumer Protection Act and using the domain name with bad faith intent to profit from the goodwill of the Casas Bahia trademark.
