Bennet Moskowitz is a partner in the Business Litigation practice at Troutman Sanders LLP. Bennet focuses on litigation involving contract law, business torts, judgment enforcement, intellectual property, and bankruptcy, among other areas. He represents clients in federal and state courts throughout the country, in all phases of litigation, including trials and appeals. Bennet also has extensive arbitration and mediation experience.

Representative Matters

  • Obtained a unanimous, full-fledged New York State appellate court (First Department) decision affirming a trial court’s (Commercial Division, New York County) dismissal, with prejudice, of a complaint against our clients, directors and officers of an Israeli company, alleging that they fraudulently induced the plaintiff, an investment vehicle of a billion dollar private equity fund, to invest in the company. See MP Cool Invs. Ltd. v. Forkosh, 650730/15, 2016 NY Slip Op 04159 (1st Dept. May 31, 2016). The appellate court decision clarified legal principles concerning fraud claims brought by sophisticated entities and thus was featured on various news media, including the front page of the New York Law Journal.
  • Represented a national book distributor in a federal jury trial involving breaches of personal guaranties. The jury reached a verdict in the amount of over $ 18 million in favor of our client.
  • Represented a precious metals manufacturer in a federal court action brought by the manufacturer against equipment dealers to recover damages arising out of the manufacturer’s purchase of deficient manufacturing equipment.
  • Represented an international buyer of jewelry in a state court action brought against the client and others for damages arising from the defendants’ alleged purchase and sale of numerous pieces of misappropriated jewelry.
  • Represented a business executive in a state court litigation that involved various contract and tort claims brought against the client based on his alleged participation in a conspiracy to raid employees from his former employer.
  • Represented a bank in a preference action brought by a bankruptcy trustee based on the bank’s alleged receipt of over $2 million in avoidable transfers from the debtor.
  • Represented a hotel and leisure company in a trademark dispute before the U.S. Court of Appeals for the Federal Circuit.
  • Represented an accounting firm in a malpractice action brought against the firm by a former client based on the firm’s alleged failure to detect embezzlement committed by the former client’s bookkeeper.
