As a Discovery Staff Attorney, Briordy assists case teams and eMerge Discovery Attorney & Project Managers with overseeing the document review and production process. Additionally, he also conducts higher level document review and analysis. Briordy frequently serves as a review team lead where he supervises project attorneys to ensure substantive document review is carried out consistently with the directives of the case team within the deadlines required. Briordy leverages his knowledge of the facts and documents to assist case teams throughout the lifecycle of the case including preparing privilege logs, chronologies, and deposition preparation materials. Briordy also conducts targeted searches to help identify key documents, inconsistencies in the review, or non-responsive categories of documents which can be excluded from the review process.

A few additional ways that Briordy helps improve document review quality while containing costs include:

  • Performing quality control reviews of Project Attorney document review sets and providing feedback and additional training as needed to avoid the inadvertent production of privileged or non-responsive documents, as well as to ensure responsive documents are properly coded and produced.
  • Serving as key liaison between case team and the review team to ensure the reviewers are properly trained on the unique issues of the case and that they are receiving the information needed to conduct their work efficiently and accurately.
  • Working with case teams to identify the scope of review and criteria for production, including coding of documents for privilege, key issues, and/or confidentiality.
  • Providing feedback to the case team and client regarding the progress of the review.
  • Developing review workflows that reduce the time necessary to move documents through various review phases.
  • Briordy has in-depth experience in managing large teams of attorneys working on document reviews and deposition preparation for a diverse range of matters including cyber-security breaches, pharmaceutical litigation and FDA investigations, tax and captive insurance regulatory reviews, oil and gas marketing regulation, employment discrimination, Qui Tam investigations, intellectual property and patent litigation, and numerous product liability disputes.

Representative Experience

  • Generated client savings of hundreds of thousands of dollars through Early Case Assessment efforts aimed at reducing data universe at collection and processing stages in Federal Trade Commission regulatory review.
  • Drafted Electronically Stored Information protocols and protective orders for multiple clients, including FRCP 26(b) proportionality language tailored to protect clients’ foreign-based and commercially sensitive data and shift cost burden of requests for not reasonably accessible data to opposing party, while maximizing client strategic position at FRCP 26(f) conference.
  • Harnessed Relativity analytical tools to focus review of documents for financial services client preparing Hart-Scott-Rodino compliance filings for FTC and Department of Justice, resulting in dramatically reduced client bill and accelerated factual development and key documents identification for merits team.
  • Drafted legal hold and monitored preservation compliance for large U.S. retail company.
  • Counseled client regarding legal and risk mitigation strategies regarding data preservation and information governance policies while negotiating and drafting vendor contracts and service agreements for cloud data storage, contract attorney staffing, and document collection/processing/production in cyber-security breach matter.
  • Conducted custodial interviews and supervised document and data collections in multiple cases, including healthcare, captive insurance, cyber-security and pharmaceutical product liability matters.
  • Prepared deposition preparation materials, factual and legal memoranda, and witness examination strategies for product liability matters by synthesizing facts learned through review and analysis of documents and data.
  • Successfully managed document review attorney projects, including several pharmaceutical matters lasting over two years and including over 100 contract attorneys working for a single client.
  • Advised large pharmaceutical client on proper handling of cross-border data transfers from the European Union and strategies for defensible reduction of document universe by utilizing information learned from U.S. collections.
  • Analyzed privileged documents and drafted defensible privilege logs in numerous matters across a variety of practice areas, utilizing technology to reduce drafting time.
  • Gained expertise in pharmaceutical and healthcare matters involving reimbursement and electronic health records issues and challenges presented by the Affordable Care Act, HIPAA and HITECH.
  • Drafted review guidelines and protocols for multiple document review projects.
