Updated Compulsory Product Authentication Provisions Issued - 强制性产品认证管理规定
Released on July 3, 2009, and effective on September 1, 2009
The General Administration of Quality Supervision, Inspection and Quarantine (“GAQSIQ”) issued the Provisions on the Administration of Compulsory Product Authentication (“Provisions”), which replaces the previous provisions promulgated in 2001.
• Authentication
Compared with the previous provisions, the current Provisions compile rules regarding the Compulsory Product Authentication (“Authentication”) and authentication logos into a separate chapter and add the below rules:
1. The valid term of the Authentication is five years. The applicant of the Authentication shall apply for renewal within ninety days prior to the expiration of the Authentication.
2. The Provisions provide for certain circumstances under which an applicant shall apply for the change of the Authentication with a competent institution.
3. The Provisions state that an applicant may apply for the expansion of products covered by the Authentication with a competent institution.
4. The Provisions further clarify the presentation, mark, use and administration on the logo of the Authentication.
• Product Recall
If a producer or retailer whose products fall into the Catalogue of Products Subject to Compulsory Authentication finds that the product has potential dangers, which may cause harm to human health and life, the producer or retailer shall disclose to the public and report to the relevant authority such potential danger, and take measures to recall the products involved.
• Entry Inspection Administration
The Provisions add that the Entry-Exit Inspection and Quarantine Authority will examine relevant documents, such as the Authentication and the logo for the import of products falling into the Catalogue. The Provisions also provide exemptions for the examinations.
