Consumer spending is the backbone of the nation’s economy. While the market is vast, so too is the regulatory structure that governs the manufacture, distribution and sale of consumer products. The professionals in Troutman Sanders’ consumer products practice handle and advise clients through the entire lifecycle of a consumer product. This ranges from proactive guidance on compliance, to state and regulatory counseling, all the way through product liability defense, expert testimony and dispute resolution. Our consumer products safety team includes a former Commissioner for the Consumer Product Safety Commission ("CPSC") who has an intimate understanding of the CPSC and provides clients with distinct insights to help them better manage risk, anticipate issues and identify solutions to regulatory matters.

We assist clients with the development of best practices for product safety and compliance with the Consumer Product Safety Improvement Act ("CPSIA") with the goal of reducing or avoiding product recalls and product liability claims and litigation. We provide guidance regarding the development of effective compliance programs, reporting procedures, proactive risk management, supply chain reliability, safety and compliance and product testing. We also counsel clients through the product development and improvement process.

We help clients remain in compliance with the CPSIA and assists clients with their reporting obligations to the CPSC. We have experience working with clients on the implementation of product recalls, including the development of satisfactory remedies and corrective action plans. We work with third parties as necessary to ensure our clients’ corrective action plan is accepted by the CPSC, to safeguard consumer safety and goodwill and to ensure the recall process is handled efficiently and economically.

In the event a claim or litigation develops because of a consumer product, Troutman Sanders has a deep bench of product litigators to protect our clients’ interests. We regularly defend product liability tort litigation and class actions, as well as government investigations. We also have experience leading incident investigation teams consisting of subject matter experts from multiple technical and scientific disciplines.
