Government Claims and Investigations

Employers must comply with numerous and sometimes intricate government regulations. Employers need experienced and knowledgeable counsel to manage increased enforcement by government agencies, expanded protections for whistleblowers, and detailed requirements under the myriad rules that govern today’s workplaces. Troutman Sanders’ attorneys are adept at helping employers respond to changes, complaints, citations or investigations for failure to comply with federal or state regulations. We guide clients through claims or investigations brought by a range of government agencies, including the Occupational Safety and Health Administration (OSHA) and the Office of Federal Contract Compliance Programs (OFCCP).

Our primary goal is to help clients remain compliant with the various laws and regulations that affect their workforce. To do so, we assess workplace operations, then create and implement practical and cost-effective workplace standards. We routinely conduct internal evaluations and assist with on-site investigations. If litigation ensues, we have extensive experience defending employers against alleged violations including whistleblower and retaliation claims.

We also address sensitive workplace investigations of misconduct which may arise anonymously or as part of a compliance disclosure. Just as with our practice of confronting agency claims, we use a wealth of experience from complimentary practice areas including environmental, manufactures’ liability, governmental relations and critical matters to manage and advise on those concerns that arise during an engagement.

  • We conducted a pre-audit of a client's affirmative action plans and compliance with other, employment-related requirements of the OFCCP.
  • We assisted client in responding to an OSHA citation, in which the allegations threatened the sale of the property which was then on the market. We handled the investigation of the matter and worked with OSHA to settle matter in a manner that resolved the alleged safety claims.
  • We handled an extensive audit of a client's compensation system and made recommendations regarding changes that will reduce risks going forward.
  • We conducted a comprehensive, systemwide OFCCP audit on behalf of a client following a merger and integration.
  • We investigated and uncovered extensive misuse of a company’s financial controls to recover losses caused by a rogue executive.
  • We have handled dozens of investigations of claims of kickbacks, preferential treatment and criminal conduct.
