Healthcare Insurance

By its very nature, the healthcare industry involves risk. Preventing illness, treating the injured and healing the sick offer great rewards — but these services are delivered in a highly complex, constantly evolving technological, regulatory and financial environment. Insurers need knowledgeable legal counsel that can help them identify potential exposures and resolve disputes ranging from traditional quality-of-care issues to enforcement of anti-kickback, data privacy and other laws and regulations.

We have a wealth of experience representing insurers involved in the healthcare industry. We have handled high-exposure and high-risk malpractice claims against individual practitioners, groups and hospital systems; directors and officers liability exposures ranging from credentialing disputes to alleged failures to implement appropriate training, policies and procedures; cyber liability and data breach exposures; qui tam and whistleblower claims; and regulatory (e.g., Recovery Audit Contractor (RAC) audits and billing fraud) and antitrust exposures.

  • Represented a primary insurer in connection with antitrust claims brought by the Federal Trade Commission (FTC), state attorney general and private (competitor) plaintiff concerning the acquisition of a physician practice by a hospital system.
  • Investigated and litigated potential rescission issues arising out of misrepresentations on policy applications.
  • Represented a carrier of an individual practitioner facing exposure in connection with the largest case of sexual abuse involving minors outside of the clergy-abuse arena.
  • Represented a cyber liability carrier for a hospital system that suffered theft of computers containing confidential patient records.
  • Assisted clients in assessing, developing and implementing trial and resolution strategies in connection with malpractice claims stemming from birth traumas, surgical errors and “angel of mercy” incidents.
  • Represented multiple clients in connection with potential exposures involving multiple insureds as a result of their use of tainted pharmaceutical products.
