Jay Dubow, a co-leader of Troutman Pepper’s Securities Investigations and Enforcement Practice Group, was quoted in the Law360 article, “Companies Scramble to Meet SEC’s SolarWinds Info Deadline.”

“There were so many companies impacted [by SolarWinds] that they found this to be the most expeditious way to get information that they can process, and I think the staff should be commended for coming up with a reasonable way to go about this,” Jay Dubow, a Troutman Pepper partner and former branch chief in the SEC’s enforcement division, told Law360.

“It’s case by case, but so far we’ve generally been advising clients to cooperate with the SEC’s investigation,” he said. “We don’t see any downside and we see upside in the so-called amnesty that’s being offered.”

“It could be clearer,” Dubow noted, a sentiment echoed by other attorneys counseling clients on the matter.

“Because for some clients they got caught in spam filters, they are just becoming aware of this, and some [likely] haven’t even been made aware yet,” Dubow said.
