Del. Solar Ruling Warns Insureds Against Overconfidence
Jennifer Mathis, a partner with Troutman Pepper, is quoted in the Law360 article, " Del. Solar Ruling Warns Insureds Against Overconfidence."
First Solar and Jarden "should give everybody pause about trying to make overbroad predictions about whether a particular court is always going to be favorable for policyholders or the insurer," said Jennifer Mathis, a partner
at Troutman Pepper who represents carriers.
The rulings "demonstrate the dangers of being overly confident about how you think a court might come out on an insurance coverage issue just because it has in recent years ruled in favor of policyholders more often than carriers,"
she said.
...
"Delaware Supreme Court just brought everyone back to the focus that you've got to look at what the policy language says," Mathis said.
