Their article, “ Environmental Liability in Commercial Real Estate and Lending Transactions – Recent Litigation, New Statutory Defenses,” discusses the liability that property owners face since the passing of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). They write, “The fear of taking on environmental liability associated with buying and financing commercial real estate is well established. And judging by the outcomes in recent cases, purchasers often are still on the losing end of purchasing environmental liabilities.
