Tim McHugh, an attorney in the firm’s Regulatory Investigations, Strategy + Enforcement (RISE) Practice Group, was quoted in the October 6, 2022 Law360 article, “Fed. Circ. Questions Congressional Intent in GI Bill Case.”

We certainly believe that Congress approaches these regulatory, these statutory, schemes in a pro-veteran manner and it should be interpreted in that way from the outset by the court to try to make sense of what is going on here.

If Congress intends to do that, it must say so clearly. And that is not the case here. GI Bill educational benefits have always been intended to support returning veterans. Congress has long recognized that more qualifying service begets more such benefits. The Federal Circuit should affirm the Veterans Court’s decision.

He had to do that. It’s the way that the VA Form and the electronic system is set up.
