Our litigators do more than advocate effectively for our clients in arbitrations across the globe. They also serve as arbitrators and chairs in three-member panels, giving us unique perspective into how arbitrators are likely to rule in complex arbitrations.

Our international litigation and arbitration experience is wide-ranging across areas such as construction, energy, securities, insurance and reinsurance, including Bermuda Form arbitrations, FCPA, international trade, patent litigation, unfair competition, tax and antitrust, and includes the enforcement of awards from international arbitrations. We litigate in U.S. courts as well as before such forums as the International Chamber of Commerce Court of Arbitration (ICC), the American Arbitration Association (AAA), the London Court of International Arbitration (LCIA), the London Maritime Arbitrators Association (LMAA), the International Centre for Settlement of Investment Disputes (ICSID), and the International Center for Dispute Resolution (ICDR), among others, where Troutman Sanders’ attorneys have handled disputes for clients in the Middle East, China, Korea, India, Vietnam, Nigeria, South Africa, Australia and various parts of Europe. The team also has significant experience handling matters involving parallel proceedings and advising clients in connection with cases occurring in and under the laws of multiple foreign jurisdictions.

Representative Matters

  • Represented a client in a maritime arbitration, subject to LMAA Arbitration Rules, in relation to a breach of charter-party claim.
  • Represented an international biologics company in an LCIA arbitration arising out of a multi-product licensing contract.
  • Represented an international electric power holding company in its effort to enforce an ICSID arbitration award against the Republic of Peru. Defeated Peru's motion to dismiss and thereafter obtained judgment.
  • Represented an investment company in an action to recognize an ICSID arbitration award rendered against the Republic of Argentina. Defeated Argentina's motion to dismiss, and then argued and prevailed on Argentina's appeal to the Second Circuit.
  • Defended a Bermuda excess insurer in a London arbitration involving complex insurance coverage claims relating to significant environmental losses.
  • Represented a multi-national corporation that had acquired a Canadian company in proceeding asserting indemnity and breach of warranty claims against selling shareholder, which was also a Canadian company.
  • Represented a multinational company in multi-million dollar international arbitration proceeding under ICDR rules regarding supply of circuit boards used in connection with fiber optic cable manufacture.
  • Defeated the enforcement of a $25 million dollar international arbitration award in the United States on behalf of a foreign government entity.
  • Represented a Swedish equipment manufacturer/turn key contractor in multi-million dollar dispute with manufacturing plant owner arising from failure on the part of the owner to pay contract sums due and alleged defects in supplier performance.
  • Defended a private equity company in an ICC arbitration proceeding arising from claims of breach of contract and breach of fiduciary duty.
  • Represented a multinational water supplier in arbitration in Toronto, Ontario under ADR Chambers International rules against Chinese manufacturer of water dispensers.
  • Represented sales representatives in an international arbitration involving multi-million dollar radiosurgery systems.
  • Represented an Indonesian conglomerate in UNCITRAL arbitration concerning a dispute over joint venture retail operations.
  • Defended an offshore energy service company in dispute arising from a foreign offshore construction project.
  • Represented a major U.S. defense contractor in breach of contract lawsuit in an ICC arbitration against a European defense contractor.
  • Represented a NY-based defense industry corporation in post-closing adjustment arbitration against a French industrial company.
