Justin Brandt is an associate in the firm’s Consumer Financial Services practice, with a primary focus on Financial Services Litigation. Justin regularly represents clients in federal and state courts and arbitration tribunals in consumer disputes, business disputes, complex litigation, and class action litigation. Justin also frequently counsels clients to ensure compliance in the consumer law and financial services areas.

Justin’s practice focuses on consumer protection statutes and regulations such as the federal Telephone Consumer Protection Act ("TCPA"), Fair Debt Collection Practices Act ("FDCPA"), Fair Credit Reporting Act ("FCRA"), and the Federal Trade Commission’s Holder in Due Course Rule ("the Holder Rule"), as well as California’s Rosenthal Fair Debt Collection Practices Act ("Rosenthal Act"), Consumer Legal Remedies Act ("CLRA"), and Unfair Competition Law ("UCL").

In addition to his bar and court admissions, Justin plays an active role the firm’s nationwide consumer law defense practice, and has been counsel to companies in federal, state, and/or arbitration proceedings in Alabama, Arkansas, Georgia, Illinois, Indiana, Louisiana, Maryland, Missouri, New Jersey, New York, North Carolina, Oklahoma, Tennessee, Texas, and Virginia.

Justin provides analysis and commentary on legal and business developments in the consumer financial services industry, with a focus on auto finance, consumer litigation, and regulatory developments, through the Consumer Financial Services Law Monitor blog at cfslawmonitor.com.

  • Reese v. Anthem, Inc., et al., No. 17-07940 (E.D. La. Mar. 12, 2018): Motion to Dismiss granted with prejudice in a TCPA putative class action relating to informational health care-related text messages.

  • Lindblom v. Santander Consumer USA Inc., No. 1:15-cv-00990 (E.D. Cal. January 26, 2018): Defeated Motion for Class Certification in Rosenthal Act class action.
  • Ewing v. SQM US, Inc., et al., No. 16-cv-1609 (S.D. Cal. Sept. 29, 2016): Motion to Dismiss granted with prejudice in a TCPA putative class action for lack of standing.

  • Represented various banking institutions and financial services companies in individual and class action TCPA, FDCPA, and FCRA litigation.
  • Represented automotive lenders for various California state law claims under the Rosenthal Act and those invoking the Holder Rule.
  • Represented a Fortune 100 company in multidistrict litigation ("MDL") involving a massive cyberattack, including taking numerous depositions of plaintiffs.
  • Represented mortgage loan servicers in litigation involving title and foreclosure, including defeating wrongful foreclosure claim with motion for judgment on the pleadings.
  • Represented an income tax service provider in purported class action lawsuit for alleged TCPA violations.
  • Represented a telecommunications company for responses to third-party subpoenas for document production.
  • Represented a developer in opposing writ of mandate action filed by activist group under Proposition G, the San Diego City Charter, and the California Environmental Quality Act.


  • Represented automotive lenders before the American Arbitration Association ("AAA") and JAMS, Inc. in disputes involving the TCPA, FDCPA, Rosenthal Act, breach of contract, and various state law claims, including defeating such claims at summary judgment stage.
  • Successfully compelled arbitration in numerous cases initially filed in state and federal courts.

Regulatory & Compliance

  • Represented health insurance plan provider in petitioning the FCC relating to its interpretation of the TCPA.
  • Counsel for various companies regarding internal controls, policies, and procedures concerning TCPA and other consumer protection statutes.
