Marlee Waxelbaum is an associate in Troutman Sanders’ Financial Services Litigation practice. Marlee has defended consumer-facing companies of all types in defense of individual and class action cases in many states, including Arizona, Georgia, Louisiana, Maryland, Nevada, New Hampshire, New Jersey, New York, Ohio, and South Carolina. Marlee’s practice includes representing national, regional and local banks, non-bank lenders, and mortgage servicing companies in federal and state litigation, including claims under the Fair Credit Reporting Act (FCRA) and Regulation V (Reg V), Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA), Truth in Lending Act (TILA) and Regulation Z (Reg Z), Real Estate Settlement Procedures Act (RESPA) and Regulation X (Reg X), other federal and state consumer protection statutes, and common law. Marlee also represents national insurance companies in federal and state litigation, including claims under the Employee Retirement Income Security Act (ERISA). Marlee has represented companies and individuals in a variety of commercial litigation practice areas including bankruptcy, construction, intellectual property, real estate, and related complex litigation matters.

Marlee graduated from the University of Virginia School of Law. While there she served as Columns Editor of the Virginia Law Weekly and as an Assistant Development Editor for the Journal of Law and Politics. Marlee graduated magna cum laude with high honors from the University of Georgia where she received the Foundation Fellowship – the University’s premier academic undergraduate scholarship. Prior to attending law school, Marlee participated in a one-year fellowship with the American Constitution Society for Law and Policy in Washington, D.C.

Marlee provides analysis and commentary on legal and business developments in the consumer financial services industry, with a focus on credit reporting and data brokers, through the Consumer Financial Services Law Monitor blog at cfslawmonitor.com.

Representative Matters

  • Represents national and regional banks and mortgage servicing companies in defense of FCRA, FDCPA, RESPA, TCPA, TILA, and wrongful foreclosure claims brought in Georgia, Louisiana, Maryland, and South Carolina state and federal courts.
  • Represents national mortgage servicing companies in defense of FCRA class action claims brought in Maryland, Nevada, New Hampshire, and Ohio state and federal courts.
  • Represents a major national insurance company in defense of contract disputes with providers and in defense of ERISA lawsuits involving claims for benefits.
  • Represented leading boiler designer and manufacturer in multi-party arbitration involving claims related to supply and erection of coal fired boiler.
  • Represented a major commercial real estate company in construction and lease disputes with commercial tenants.
  • Represented a national retailer in state and federal court actions in South Carolina arising out of dispute over construction build out and claims for breach of contract.
