Thomas DeVita is an associate in the Energy section of Troutman Sanders, working in the firm’s Washington D.C.-based Federal Energy Regulatory Commission (“FERC”) practice group. Thomas’ practice is primarily focused on the representation of investor-owned utilities and merchant generators before FERC, with a particular emphasis on electric transmission, energy storage systems, FERC-jurisdictional rates and tariffs (both cost-of-service and market-based), electric reliability, and rules governing the regulation of organized wholesale markets.

Thomas has experience advising clients on matters involving (but not limited to):

  • Open Access Transmission Tariffs and associated FERC precedent (e.g. Order Nos. 888, 890, etc.);
  • Compliance with North American Electric Reliability Corporation (“NERC”) mandatory reliability standards, including Critical Infrastructure Protection (“CIP”) standards;
  • Registration for specific NERC functions, including application and implementation of Joint Registration Organizations (“JROs”) and Coordinated Functional Registrations (“CFRs”);
  • Formula rates (both transmission and generation), as well as stated rates;
  • Applications for market-based rate authority, and ongoing compliance obligations arising under Electric Quarterly Reports (“EQRs”) and updated market-power analyses (triennials);
  • Transfers of FERC-jurisdictional assets under Section 203 of the Federal Power Act;
  • Issuance of utility debt under Section 204 of the Federal Power Act;
  • Filing of tariffs, rate schedules, and service agreements under Section 205 of the Federal Power Act;
  • The Uniform System of Accounts (18 C.F.R. Part 101);
  • Tariff, rate schedule, and service agreement forensics in FERC databases and filing records; and
  • eTariff implementation, application, and logistics.
