Entitlements Under China’s Social Security System Clarified
On June 30, 2011, Ministry of Human Resources and Social Security promulgated Several Provisions on the Implementation of the Social Security Law of the People’s Republic of China 实施《中华人民共和国社会保险法》若干规定 (the “Provisions”) which came into effect on July 1, 2011. The Provision covers basic pension insurance, basic medical insurance, work-related injury insurance, and unemployment insurance.
Basic Pension Insurance: if an individual has paid premiums less than 15 years when he/she reaches the statutory retire age, he/she may pay premiums for an extended period to meet the 15-year period requirement. If such extended period is more than 5 year, he/she may pay the premiums in a lump sum to meet the 15-year period requirement in condition that he/she has participated in social security before the Social Security Law came into effect. If the insured passed away, the balance of his or her personal account can be inherited according to law.
Work-related Injury Insurance: if an employee (including part-time employee) works for two or more than two employers simultaneously, each employer shall contribute work-related injury respectively for this employee. In the event that this employee suffers a work-related injury when he or she works for one of the employers, this employer shall undertake liability for work-related injury insurance according to law.
