8th Circ. Sets Standing Marker With Data Breach Rulings
Partner David Anthony is quoted in a Law360 story about implications of the Eighth Circuit court’s rulings in a pair of putative data breach class actions. Anthony is quoted, saying, "These two decisions from the Eighth Circuit illustrate the continued divergence of opinions regarding Article III standing for data breach claims.” He continues, saying, "Following the Supreme Court’s decision in Spokeo, these Eighth Circuit opinions help to confirm that standing requires a 'concrete injury' or one that is 'real and not abstract.' Not surprisingly, courts will continue to struggle with these distinctions, and plaintiffs counsel will continue their efforts to establish Article III standing for data breach claims."
