Insurers disclaim coverage for lawsuit alleging FCRA violations
Washington partner John Duchelle, Washington associate Darren Dwyer, and Richmond associate Nick Klaiber were mentioned in a June 30 Insurance Law & Litigation article – "Insurers disclaim coverage for lawsuit alleging FCRA violations"– for representing Homeland Insurance Co. of New York in a case that involves allegations that General Information Services did not notify consumers that background checks were being used in “their employment applications in violation of the Fair Credit Reporting Act.” Per the article, Homeland is alleging that even though it had a valid $5 million excess policy at the time of the underlying lawsuit, “the insured attempted to purchase additional coverage after the suit was filed.”
The trio of firm lawyers is acting as counsel for Homeland in the lawsuit.
