Before retiring from the firm, Karen F. Lederer had a depth of experience in advising retailers, manufacturers, and other providers of consumer goods and services on legal compliance in the areas of advertising and marketing – native advertising, endorsements and testimonials, loyalty programs, gift card programs, sweepstakes and contests, comparison price advertising, charitable sales promotions, coupons and rebates, labeling, warranties, internet marketing, telemarketing, in-home sales, and Federal and State product-specific regulations. In addition, she defended these companies against claims of unfair and deceptive trade practices, in consumer class actions and in investigations brought by the New York State Attorney General and other State Attorneys General across the country, the FTC, and the New York City Department of Consumer Affairs.
In the area of product safety, Karen advised companies on CPSC product testing and labeling/tracking requirements, and on conducting a CPSC recall. She also handled NHTSA after-market parts recalls. She counseled clients on FDA requirements for labeling and marketing food and dietary supplements and handled FDA food and medical device recalls. Additionally, she efficiently and effectively resolved many California Prop. 65 cases.
Karen counseled retailers, sales finance companies and banks on documenting credit extensions in compliance with Retail Installment Sales Acts, Holder in Due Course Rules, and Truth-in-Lending. She also counseled debt buyers and debt collection agencies on compliance with the Fair Debt Collection Practices Act and defended companies in consumer credit class actions and investigations by the CFPB, the FTC, the New York State Attorney General, other State Attorneys General across the country, and the New York City Department of Consumer Affairs.
She represented numerous for-profit post-secondary schools, both publicly and privately held, in investigations by federal and state education, consumer protection, and law enforcement agencies.
Karen also represented companies of all stripes in complex commercial litigation in federal and state courts, and in arbitrations and mediations.
