As with any rapidly evolving technology of this magnitude, the use and implementation of GenAI presents a wide range of legal issues – including privacy and data security, information governance, intellectual property, compliance, labor and employment, contractual, and risk management concerns — requiring legal counsel who understand both the technologies and how to mitigate the evolving legal challenges. Federal and state legislators and regulators are increasingly proposing laws and regulations — and in some cases launching investigations and litigation — aimed at a wide range of GenAI use cases.
Our Use of Generative AI
We have long been at the forefront of using new technologies, including GenAI, for data analytics, process improvements, and automation, including through our nationally recognized eMerge subsidiary. Our attorneys, legal technologists, data scientists, and engineers regularly develop, test, and pilot GenAI solutions, carefully ensuring that every use case is thoroughly vetted for legal and business risks before implementing them with clients or our attorneys. Under the guidance of our Generative AI Task Force ─ composed of attorneys, technologists, and business professionals across the firm ─ we built the necessary infrastructure for secure testing of GenAI/LLMs to find use cases that will benefit our clients and the firm. In August 2023, our firm unveiled Athena, a ChatGPT application to help attorneys and business professionals safely and effectively use GenAI to improve workflows and enhance client experiences.
