Consumer's Receipt Suit Doesn't Hold Up Under Spokeo
Troutman Sanders partner Joshua Berman and associate Bennet Moskowitz were mentioned in a January 31 Law360 article for their representation of Paris Baguette America Inc. The article reported that U.S. District Judge Jed S. Rakoff (S.D.N.Y.) issued a decision dismissing a consumer’s proposed class action lawsuit alleging that Paris Baguette violated the Fair and Accurate Credit Transactions Act by printing too much of its customers’ credit card information on receipts. Judge Rakoff had previously dismissed the lawsuit back in 2014. While on appeal, the Court of Appeals for the Second Circuit sent the case back to the District Court to permit the plaintiff to attempt to comply with the pleading requirements for standing that are set forth in the U.S. Supreme Court’s recent Spokeo decision.
